Mr Rahul was engaged to appear for the 1st defendant/promoter and had argued that the cancellation of the Power of Attorney in favour of the promoter was illegal & non-est. It was further contended that when the promoter has completed the project as per the terms of the joint venture agreement and no relief has been claimed seeking cancellation of the Joint Venture agreement; the suit has to be dismissed. Accepting the contentions & arguments put forth; the suit was decreed as prayed for in favour of the promoter.
