Madras High Court sets aside Trial courts impugned order directing the plaintiff to pay a court fee of Rs 15,00,000/-

Mr Rahul Jagannathan was engaged to appear on behalf of the plaintiff before the high court and had argued that the court fee would be computed under Section 25(D) of the Tamilnadu Court Fee and Suit Valuation Act, 1955 and not under Section 25(A) & (B) of the Act. It was further argued that the difference in court fee demanded by the trial court in comparison to the actual court fee would be approximately 14,99,000/-. Therefore, accepting the arguments placed by Mr Rahul; the Hon’ble Madras High Court has set aside the trial courts order and directed the trial court to compute the court fee under Section 25(D) and number the declaration suit.
