Mr Rahul Jagannathan was engaged to appear for the complainant and had argued that was a case of cheating on the face of it owing to the fact that the accused had promised to sell a property to the accused. However, after receipt of the entire sale consideration, they had mortgaged the property and refused to sell the property to the complainant.
